R3 are excited to announce the Personal Insolvency Forum, taking place in London on 22 February 2024! This one-day forum will cover the key issues that insolvency practitioners face, providing practical insights and technical updates on the everyday challenges within personal insolvency cases.

Our aim for this Forum is to provide you with an opportunity to engage with these key policy matters within the personal insolvency sector. You can look forward to an update from the Insolvency Service alongside other topical sessions including: personal liability of directors, looking after your colleagues in stressful case situations and more. The Forum offers lots of networking opportunities for you to build new connections and catch up with previous acquaintances – including our networking drinks reception at the end of what should be an engaging and informative day.

Insolvency Service update 

In 2022 the government commenced a comprehensive review of the personal insolvency framework. This session recaps the findings to date from the Insolvency Service's call for evidence and its work in the area of personal insolvency, and will provide you with an advance look at some of the next steps in the coming year.

Wellbeing: Looking after your colleagues in stressful case situations 

The job of an Insolvency Practitioner involves dealing with individuals in sometimes desperate situations. People deal with stress in different ways but it is important to remember that your own staff need looking after when dealing with stressful situations. Whether it is a disgruntled workforce, an angry creditor or individuals faced with losing their way of life we need to be able to spot when out staff are not coping and signpost them to where they can talk or seek help. It is a not a weakness for staff to say that they need help. Equally it is strong leadership to spot where help is needed or would be appreciated.

Advertising/ethics of getting work in and how IPs promote themselves 

From having a PO Box address to getting on the OR Rota, or to paying an accountant for assistance with the Statement of Affairs, there is a long history of IPs complaining about the way in which their competitors get their work. But is it true, and do we help ourselves by making these allegations about each other?

Best advice to debtors 

Debtors seeking assistance from the insolvency profession come in all shapes and sizes, for a variety of reasons and from a wide range of sources.  This session will update practitioners on the latest changes to SIP 3, debt packagers fees and the FCA Consumer Duty.  Three IPs bringing with them different experiences from across the profession will then apply the concept of best advice to the wide range of situations and clients we are faced with in practice.

Personal liability of directors   

This session aims to focus on the ways in which directors of insolvent companies can be liable for a range of debts whether as a result of guarantees, indemnities, overdrawn loan accounts or where they can be made personally liable for the tax debts of a company. What you need to know to understand and help properly advise directors facing personal indebtedness resulting from a variety of claims. The session will be presented by a senior IP and a tax specialist.

Personal insolvency: The creditors perspective  

Lee Usher and Peter Wallwork joined Trustfolio having spent the majority of their careers working for or closely with large Creditors.
