In this case it was decided that a prosecution could be brought against an administrator under the Trade Union and Labour Relations (Consolidation) Act 1992 Pt IV s.194(3) for conniving in the employer's failure to give notice to the Secretary of State of a proposal to carry out collective redundancies as an administrator is an officer of the company for the purposes of section 194(3). View
