The Corporate Insolvency and Governance Act 2020 introduced two new tools for the profession, the Moratorium and Restructuring Plan, which have yet to take off in terms of use for SMEs and mid-market companies. In this session our speakers explore the possibilities of using these restructuring tools for SMEs and mid-market companies and the role of the IP in their hypothetical future. From an overall perspective, this session considers these restructuring tools with the following questions being discussed:
- How can the Moratorium and the Restructuring Plan apply in the mid-market?
- Can these tools really be a cost effective tool in the mid-market?
- How can the Moratorium and Restructuring Plan interact with one another?
- Advantages of these restructuring tools in the mid-market?
- How essential is it for a director to recognise the signs of financial distress in order for these tools to be an option?
- Are these tools the future of the profession? Does the profession need a change in mindset?
