Interview: The Dutch ‘Restructuring Expert’ role, and how it was central to the McDermott case In this session we are joined by Michael Broeders of Freshfields in Amsterdam. This Spring the highly contentious restructuring of a US multinational, McDermott International, reached the London courts. The six-day Sanction hearing to decide whether McDermott’s English Part 26A Restructuring Plan should go ahead intersected with both a Chapter 15 process in the US and a WHOA in The Netherlands, leading to a dramatic settlement based on the suggestions of the Dutch Restructuring Expert, a recently introduced role provided by the WHOA. McDermott’s Restructuring Expert Michael Broeders describes first-hand the innovative restructuring and what lessons it provides for the future.
