This webinar examines how digital assets and cryptocurrencies can be classified, held and managed, and how basic legal and insolvency principles can be applied in this fast-developing area.

It will consider whether cryptocurrencies constitute property and, if so, what type of property they are. The session will also explore practical issues around managing digital assets, including whether they may be secured, held on trust, treated as shares or contractual claims, or subject to set-off arrangements.

Further topics include where digital assets are held, which laws and jurisdictions apply to them, and how practitioners should approach conflicts of laws, international co-operation, treaties, centre of main interests, and the lack of a consistent global consensus.

The webinar will also address how insolvency processes operate in a world of digital value fluctuation, which procedures may be most suitable in different cases, the relevance of global case law and statute, and how smart contracts may affect insolvency practice in future.
