Intellectual property rights often go unidentified and unrealised in an insolvency yet they can be hugely valuable - they may be the major asset available to an insolvency practitioner. In this talk, Nicholas Caddick Q.C. of Hogarth Chambers gives an overview of the sort of intellectual property rights that an insolvency practitioner may encounter and the issues that may need to be addressed in order to realise the value of those rights. Areas covered will include:

  • A brief introduction to intellectual property rights - patents, trade marks, designs, copyright, confidential information and domain names
  • Ownership of intellectual property rights
  • Assignments and licensing of intellectual property rights
  • Protecting intellectual property rights - practical steps, including suing (covering the Intellectual Property Enterprise Court)
  • Realising value
