Rachael Markham and Eleanor Temple KC will discuss (i) the definition of a 'secured creditor' for the purposes of the Insolvency Act 1986, following the recent decisions in Hobson v OAS Realisations Ltd, Re Pindar (Scarborough) Ltd and Toogood International Transport and Agricultural Ltd, and (ii) the concept of 'misfeasance trading' following the decision in Re BHS Group Ltd.
