In this detailed two part series, insolvency experts from Jersey and Guernsey outline the nature of the jurisdictions and the main corporate insolvency procedures available on these two islands.

Part one gives an introduction to the islands and a run through the nature of the jurisdiction and instances where UK lawyers and IPs may find themselves with a Channel Islands connection.

Part two provides a more detailed look at the powers and duties of office holders appointed as administrators and liquidators, and also considers proposals for insolvency reform for both islands.


Jeremy Garrood: Partner, Jersey, Carey Olson
Jeremy is an experienced offshore practitioner who has worked in Bermuda, the Caribbean and the Channel Islands, handling cases across the core offshore disciplines of trust, insolvency and company litigation.
Jeremy has strong insolvency and restructuring experience having dealt with numerous cross-border insolvencies, asset recovery/tracing cases and receiverships. He has been instructed in factually and legally complex company law cases concerning minority shareholder actions, corporate governance disputes and schemes of arrangement, in the context of general operating companies, cell companies and other investment vehicles. Jeremy continues to be instructed in enforcement actions under the Security Interest (Jersey) Law 2012.
Alan Roberts: Director, Grant Thornton
Alan qualified with a big 4 firm, is a UK Licensed Insolvency Practitioner, Certified Fraud Examiner and has over 30 years’ experience in insolvency and restructuring work.

Alan has worked in the UK, Continental Europe, Russia, the US, Caribbean, Far and Near East, Mediterranean hub and the Channel Islands. He has a wide depth of experience on international restructuring and insolvency appointments. He is particularly experienced in asset recovery, cross border contentious insolvency litigation.
David Jones: Partner, Guernsey, Carey Olson
David is an advocate providing specialised advice in relation to business restructuring and insolvency in contentious, non-contentious and multi-jurisdictional matters.

In his time with Carey Olsen David has been involved in many of the largest insolvencies involving Guernsey entities, ranging from investment funds to global retailers. He is able to assist lenders in respect of the taking and enforcement of all forms of security. David regularly advises the boards of distressed entities and has extensive experience acting for office holders.
